In the unfortunate event that a worker dies on the job, his or her dependents are entitled to workers’ compensation death benefits. Under both Florida and Indiana workers’ compensation law a deceased person’s family is entitled to funeral expenses. Additionally, so long as dependency can be established, (meaning that the person making the claim relied upon the deceased individual’s income for support), certain family members are entitled to “dependency” benefits. Unlike a civil case no probate estate or personal representative is required. The most common dependents are spouses and children, but dependents can also include parents, brothers, sisters, and other family members.
Usually the cause of death is obviously from working and the main reason for hiring a lawyer is to assist in negotiating a lump sum payment of the benefits available. Many times people are worried about the lawyer’s percentage taking away from what they will receive. However, I have both heard and seen firsthand that the same is usually not the case for one big reason—the amount that you will be able to obtain on your own is almost always less than the amount you will get with a lawyer’s guidance (even after deducting your lawyer’s fee).
