IT GET WORSE FOR REPEAT OFFENDERS

If you accumulate several traffic violations then you can potentially trip over into the Habitual Traffic Violator status. This status is not one you should aspire for and it isn’t exactly easy to get either.

FIVE YEAR Habitual Traffic Violator

If convicted of one major offense and nine minor violations over ten years, the BMV will label you a habitual traffic violator for five years. They also suspend your license for that same period of time five years. A major conviction includes offenses such as operating without ever having received a license or being suspended, reckless driving, DUI or operating while intoxicated convictions, or failure to stop after an accident among others. A minor offense includes almost any type of traffic offense. See I.C. 9-30-10-4(c).

TEN YEAR Habitual Traffic Violator

The ten year HTV status is triggered when convicted of three major traffic offenses in a ten year period. This one comes with a license suspension as well but is ten not five years. Offenses under this section include felony criminal recklessness involving a vehicle, reckless driving, operating while intoxicated, failure to stop after an accident causing death or injury, or OVWI causing death, along with others. See I.C. 9-30-10-4(b).

MAXIMUM PENALTIES?

LIFETIME Habitual Traffic Violator

If convicted of two serious traffic offenses in a ten years, you will earn a habitual traffic violator for life. A serious offense for this section includes reckless homicide involving the operation of a vehicle, manslaughter involving the operation of a vehicle, and operating while intoxicated causing death, among others. A suspension under this section is indefinite. See I.C. 9-30-10-4(c).

Driving While HTV

If you are HTV and caught driving after receiving proper notice, you will be charged with a Level 6 felony and may have your license suspended for life if you are convicted of the felony. If caught driving on a life time suspension, you will be charged with a Level 5 felony.
