If you accumulate several traffic violations then you can potentially trip over into the Habitual Traffic Violator status. This status is not one you should aspire for and it isn’t exactly easy to get either.
FIVE YEAR Habitual Traffic Violator
If convicted of one major offense and nine minor violations over ten years, the BMV will label you a habitual traffic violator for five years. They also suspend your license for that same period of time five years. A major conviction includes offenses such as operating without ever having received a license or being suspended, reckless driving, DUI or operating while intoxicated convictions, or failure to stop after an accident among others. A minor offense includes almost any type of traffic offense. See I.C. 9-30-10-4(c).
TEN YEAR Habitual Traffic Violator
The ten year HTV status is triggered when convicted of three major traffic offenses in a ten year period. This one comes with a license suspension as well but is ten not five years. Offenses under this section include felony criminal recklessness involving a vehicle, reckless driving, operating while intoxicated, failure to stop after an accident causing death or injury, or OVWI causing death, along with others.
